Artikel 38

  1. If the Court declares the application admissible, it shall

    1. pursue the examination of the case, together with the representative of the parties, and if need be, undertake an investigation, for the effective conduct of which the States concerned shall furnish all necessary facilities;

    2. place itself at the disposal of the parties concerned with a view to securing a friendly settlement of the matter on the basis of respect for human rights as defined in the Convention and the Protocols thereto.

  2. Proceedings conducted under paragraph 1 b) shall be confidential.
