Artikel 422a

  1. Indien het gerechtshof van oordeel is dat de dagvaarding in eerste aanleg op een andere grond dan wegens een aan de telastelegging klevend gebrek nietig had behoren te worden verklaard, kan het met instemming van de advocaat-generaal en de verdachte niettemin de zaak zelf afdoen.

  2. Het eerste lid is van overeenkomstige toepassing, indien de oproeping of aanzegging om op de nadere terechtzitting in eerste aanleg te verschijnen nietig had behoren te worden verklaard.

  1. Indien het gerechtshof van oordeel is dat de dagvaarding in eerste aanleg op een andere grond dan wegens een aan de telastelegging klevend gebrek nietig had behoren te worden verklaard, kan het met instemming van de advocaat-generaal en de verdachte niettemin de zaak zelf afdoen.
